Terms and Conditions

 

At Carefree Cycling Tours (hereinafter called ‘the Company’, ‘we’ or ‘us’) we aim to treat all our customers fairly. The following booking conditions set out our obligations to you when you book with us, and also lets you know what we expect from you. All cycling tours and experiences listed on our website are sold subject to the following conditions.

 

1. Booking a holiday. Before booking a holiday please read the holiday description, tour dossier and these booking conditions. If you have any questions please contact us for clarification. To make a booking a booking form can be completed and sent to us with a non refundable deposit of 10% for each person. Alternatively, a booking can be made over the telephone or via our web site and sending us 10% deposit for each person. By paying the deposit, and thus indicating a desire to book with us, you will be deemed to have accepted the terms and conditions of our contract. An invoice of the booking will normally be sent within 7 working days. The booking is not accepted and no contract exists until and from the date shown on the invoice.

 

2. Payments. The balance shown on the invoice must be paid 8 weeks prior to the start of the holiday. If the booking is made less than 8 weeks before tour departure full payment must be made upon booking. If the balance is not paid in time we reserve the right to cancel your holiday and apply the cancellation charges outlined below.

 

3. Cancellation by you. Time is of the essence in the application of this clause. If you wish to cancel your holiday notice must be given, in writing, and the following cancellation rates will apply:

a. 56 days or more before tour departure – deposit only.

b. 29 to 55 days before tour departure – 50% of the holiday cost.

c. Less than 28 days before tour departure – no refund.

 

4. Cancellation by us. We will not cancel a holiday unless

a. We are forced to do so by what is known as a ‘force majeure’.

b. If the minimum number of people we require to run the tour has not been reached. In this situation we will inform you no less than 28 days before departure.

If we do cancel a tour we will offer an alternative tour. If this is not acceptable to you then a full refund will be given. We will not be liable to refund any incidental expenses that you may have incurred as a result of your booking such as travel insurance, visas, additional travel arrangements etc.

 

5. Prices of holidays. Prices featured on our website may change at any time due to factors such as changes in exchange rates, increases in transport, accommodation or other costs, or if government action forces us to do so. Once an invoice has been issued we will abide by that price save for currency fluctuation and travel cost increases.

 

6. Risks and hazards. Your booking is accepted on the understanding that you realise the risks and hazards of such a holiday, including the dangers inherent in cycling either on the road or off the road, or the dangers inherent in the other activities included in individual holidays. Your booking is accepted on the understanding that you realise the risks of such holidays in terms of potential for delays and alterations due to possible changes of local politics, weather, border restrictions, diseases, loss or damage to property, inconvenience and discomfort.

 

7. Responsibilities. All participants must agree to observe local laws and customs and abide by the authority of the tour leader. Accepting confirmation of booking signifies this and therefore, during a tour, if your behaviour is detrimental to the safety and welfare of the group in the opinion of the tour leader, you may be asked to leave the tour without the right to a refund.

By joining any of the tours described on our website you accept the potential hazards and the need for flexibility, and acknowledge that delays and alterations and their results such as inconvenience, discomfort or disappointment, are possible.

If you bring your own bike it is your responsibility to ensure that the bike is adequately maintained and insured.

 

8. Advice. Any advice provided by the Company on matters such as climate, clothing, special equipment, etc. is done so with good faith and without responsibility on our part.

 

9. Problems. Our responsibility does not commence until the appointed time at the designated meeting place for the tour. If you fail to arrive at the meeting place at the appointed time, for whatever reason, we will not be responsible for any additional expenses incurred by you in joining the tour. No refund or compensation will be given for any unused or untaken portions of the holiday, including travel arrangements, accommodation, food and services, should you be unable or choose not to complete a tour.

 

10. Complaints. We want to provide the best care for our clients. If you have any complaints please make them initially to the tour leader who will endeavour to solve the difficulties. If you feel your complaint was not dealt with to your satisfaction, please outline the details of your complaint and notify us in writing within 28 days of the completion of the tour.

 

11. Liabilities. The Company shall not be held liable for any loss or damage caused by the total or partial failure to carry out the contract if such failure is:

a. Attributable to you as a consequence of your acts or omissions.

b. Attributable to a third party.

c. As a result of circumstances beyond our control such as strikes, war, civil or political unrest, government action, Act of God or what is known as a ‘force majeure’.

d. A result of an event that we could not reasonably foresee or forestall.

e. Due to the theft of bicycles.

f. Injury as a result of cycling either on or off road and in particular injuries as a result of inadequately maintained and serviced personal equipment or failure to wear the correct safety equipment, most notably cycle helmets.

 

12. Personal Insurance. You are responsible for any loss or damage to baggage, bicycles or personal possessions or any consequential loss there from. You should be therefore be adequately insured against personal injury, loss, theft or damage. You should keep valuables safely with you at all times and we strongly recommend that you have adequate travel insurance. If you are a booking in Europe travel insurance is compulsory. If you reside outside the UK you must have your own travel insurance and must provide policy number and insurance company name on the booking form.

13. Carefree Prize Draw
a. Entrants must be age 16 or above.
b. Employees and their immediate families of the promoter, its agents or anyone professionally connected with the promotion will not be entitled to participate.
c. Prize is transferable but holds no cash equivailant value.
d. By taking part in the promotion, the prize winner confirms their agreement to take part, and allow the use of their name,in any associated publicity.

 

14. Carefree Ride Club.

 

You do not have to supply any personal information to use this site, and we do not collect or share any information about you without your permission. The information that you provide will only be used for the purposes that you have specified. You can access, change and delete your personal information from our records at any time. If you have any questions, problems or complaints with our site, please email privacy@carefreecyclingtours.co.uk
We respect each individual’s right to personal privacy. We will collect and use information through our Web site only in the ways disclosed in this statement. This statement applies solely to information collected at the carefree Cycling Tours Web site.

a. Information Collection. We collect information through our Website at the point of subscription and registration. We collect the following information about primary visitors: email address, name, and address. We may also collect email addresses which our users divulge about other people, such use is for referrals. Carefree Cycling Tours Ltd does not actively market to children, and we never knowingly ask a person under 18 to divulge personal information. We collect the following general data that is not personally identifiable information: user name/handle, city, and postcode. We collect this information through registration forms and automatic logging files, and so on. This data is collected by the user entering it or by logging onto the site. The information is collected voluntarily. To register onto the Carefree Ride Club a user name and email address is mandatory, so that the user may log into and use the site. Other information we request is optional.

b. Information Usage. The information collected by Carefree Cycling Tours Ltd will be for internal and marketing use only. Users who provide information will receive email announcements or advertisements.
Subscribed users will receive additional announcements from us about products, services, special deals, and a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications. The information we collect will not be used to create customer profiles based on browsing or purchasing history. We will not supplement information collected at our Web site with data from other sources.

c. We offer links to other Web sites. Please note: When you click on links to other Web sites, we encourage you to read their privacy policies. Their standards may differ from ours.

d. We maintain the accuracy of our information. Users may access their own personal information and contact us about inaccuracies they may find by emailing us at support@carefreecyclingtours.co.uk and may delete their information from our database by emailing us and providing us their username and registered email address. Please allow two weeks for change to appear.

e. Problem Resolution. If problems arise, users may contact Carefree cycling Tours Ltd by e-mail. We are committed to resolving disputes within two weeks of notice.

All the above terms and conditions are governed by UK Law and are subject to the exclusive jurisdiction of the English Courts.
